Terms of Use

These Terms of Use govern your access to and use of KK Inc. (“KK”, “we”, “us”, or “our”) websites and services (the “KK Sites”). By accessing or using the KK Sites, you agree to be bound by these Terms of Use. If you do not agree, your access to and use of the KK Sites is unauthorized.

The English version of these Terms of Use shall prevail over any translations. Any non-English materials or communications are provided for convenience only and may be withdrawn at our discretion.

KK may update these Terms of Use at any time by posting a new version. Updates apply prospectively from the date they are published.

Definitions

“KK Sites” refers to our e-commerce websites, including but not limited to butuzou.com, tabishoes.com, and japaneseworkwear.com.
“You” or “your” means users of the KK Sites.
“Services” means any and all services provided by KK through KK Sites or related transactions.

1. About KK

KK was founded in Japan as an exporter of niche, hidden, and unique Japanese products. We operate multiple KK Sites including butuzou.com, tabishoes.com, and japaneseworkwear.com.

2. Account Registration

You agree to provide accurate, current, and complete account information and maintain its accuracy. You are responsible for safeguarding your login credentials and all activities under your account. You may not share, sell, or transfer your account to third parties. KK shall not be liable for damages arising from misuse or unauthorized access to your account.

3. Formation of Contract and Payment

The total amount due (product price and shipping fee) will be displayed before you place your order. A contract is formed upon KK’s acceptance of your order (“Order Acceptance”), not at checkout. Payment is processed upon Order Acceptance and may be made via PayPal or credit/debit card. Although non-JPY prices may be shown for reference, charges are made in Japanese yen. We reserve the right to cancel or reject orders containing pricing or stock errors.

4. Shipping and Delivery

Products are typically shipped via Japan Post EMS or DHL within 1–3 business days of Order Acceptance. Shipping fees are calculated based on product weight and supplier. Risk of loss passes to you upon delivery to the carrier. You are responsible for providing accurate shipping information and cooperating with delivery.

5. Refunds and Exchanges

Orders cannot be cancelled or returned except in cases of material defect (e.g., damaged during delivery). This policy exists due to the logistical complexity of cross-border shipments.

6. Import Duty and Taxes

Your order may be subject to import duties and taxes not included in your payment to KK. Any estimates provided are for reference only and not guaranteed.

7. Vouchers

Voucher codes must be entered before checkout. Vouchers cannot be exchanged for cash, refunded, or used fraudulently. KK may revoke vouchers used in violation of policy or law.

8. Points

Points may be granted for marketing purposes at KK’s discretion (1 Point = 1 JPY). Points are valid for one year but may be revoked for misuse or fraudulent activity.

9. Accuracy and Timeliness of Information

Information on KK Sites, including product descriptions, may contain inaccuracies or omissions. All product information is for reference only. KK does not guarantee completeness or accuracy and assumes no liability for reliance on such information.

11. Ownership of Rights

All intellectual property rights in the KK Sites (logos, text, images, and content) are owned by KK or its licensors. No license or right is granted to use these materials except as expressly permitted. You may not modify, reproduce, distribute, or create derivative works from any KK content.

12. Materials You Submit

By submitting materials (reviews, comments, messages) to KK, you grant us a perpetual, royalty-free, worldwide license to use, modify, distribute, and display them. You represent that you own or control all rights to your submissions and that they do not infringe third-party rights.

13. Access and Use

You agree not to misuse KK Sites, including by violating laws, hacking, scraping, or attempting to access restricted areas. Automated access, bots, or scraping tools are prohibited unless otherwise authorized in writing by KK.

14. Disclaimer of Warranties

KK Sites and their content are provided “as is” without warranties of any kind, express or implied. We do not guarantee uninterrupted access, accuracy, or security. This disclaimer does not affect manufacturer warranties that may apply to physical products.

15. Limitation of Liability

To the fullest extent permitted by law, KK and its affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your use of the KK Sites.

16. Indemnification

You agree to defend, indemnify, and hold harmless KK, its affiliates, and partners from any claims arising out of your violation of these Terms or misuse of the KK Sites.

17. Application of Japanese Law

These Terms of Use are governed by and construed in accordance with the laws of Japan. All disputes shall be subject to Japanese law regardless of your location.

18. Disputes / Arbitration

Any disputes arising from these Terms or your use of the KK Sites shall be resolved through binding arbitration in Tokyo, Japan.

19. Class Action Waiver

Disputes must be brought on an individual basis. You agree not to participate in any class, consolidated, or representative action against KK.

20. Account Termination

KK may terminate or restrict your account access at any time for violations of these Terms or at its discretion. Termination does not limit other remedies available to KK.

21. Entire Agreement

These Terms constitute the entire agreement between you and KK and supersede all prior communications, whether oral or written.

22. Others

Failure to enforce any part of these Terms does not constitute a waiver. If any provision is deemed invalid, the remainder shall continue in effect. Headings are for convenience only. KK may assign these Terms to any successor or acquirer at its discretion. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
